Welcome to Briefly. These Terms of Service set out the rules for ordering and using our productized web design service. Please read them carefully — by submitting a project brief or making a purchase, you agree to be bound by them.
This page reflects the terms you provided and is presented for convenience. It is not a substitute for review by a qualified lawyer in your jurisdiction before publishing.
These Terms of Service ("Terms") govern your use of Briefly's web design services, accessible at briefly.pt ("the Service"). By submitting a project brief or making a purchase, you agree to be bound by these Terms.
Briefly is a productized web design service operated by David Cruz, a sole trader based in Portugal ("we", "us", "our"). Our contact email is hello@briefly.pt.
If you do not agree to these Terms, please do not place an order.
Briefly provides custom website design and development services. All websites are built from scratch — we do not use templates, page builders, or no-code tools such as Webflow, Framer, or Squarespace.
The core deliverable is a custom-designed, custom-built HTML landing page. Unless otherwise agreed in writing, each project includes:

Add-ons must be selected at the time of ordering. Adding an extra page after delivery has begun may incur additional charges and extend the delivery timeline.
Orders are placed by completing the project brief form on our website. By submitting the form, you are making a non-binding enquiry. A binding contract is formed only when we confirm your order in writing (via email) and payment has been received.
We reserve the right to decline any project at our sole discretion, including but not limited to projects that:

Delays caused by late or incomplete content submission will extend the delivery timeline accordingly. Briefly is not liable for delays attributable to the client.
All prices are quoted in Euros (€) and are exclusive of VAT unless stated otherwise. VAT will be applied where required by applicable law. The current pricing is:
Prices are subject to change. The price applicable to your order is the one confirmed at the time of booking.
Full payment is required before work begins. We do not offer payment on delivery or installment plans unless explicitly agreed in writing. Accepted payment methods are listed on our website and may vary from time to time.
An invoice will be issued upon receipt of payment. If you require a specific invoicing format or purchase order number, please inform us before payment.
We aim to deliver the first draft of your website within one business day of receiving confirmed payment and a complete brief with all required content.
"One business day" means within 24 hours, counting only Monday to Friday, excluding Portuguese public holidays. Orders confirmed after 5:00 PM (GMT+1) are considered received the following business day.
Unless otherwise agreed, the deliverable is a standalone HTML file, ready to upload to any web server or hosting provider. Assets (images, fonts, icons) referenced by the file are packaged alongside it.
We do not guarantee compatibility with specific third-party platforms (e.g., cPanel, Shopify, WordPress). If you require deployment to a specific platform, please inform us before ordering so we can assess feasibility.
We will inform you promptly if a delay is anticipated. Delays caused by factors outside our control (e.g., late content, force majeure) do not give rise to a right of refund.
Each project includes one round of revisions. A "round" means a single set of consolidated feedback, submitted by email in one message, to which we respond with an updated deliverable. Revisions covered in the included round are limited to:

Requests outside this scope will be quoted separately.
Revision requests must be submitted within 7 calendar days of receiving the first draft. After this period, the project is considered complete and the revision entitlement lapses.
Additional revision rounds may be purchased at €79 per round. Additional rounds must be requested and paid for before work begins on the revision.
The monthly support subscription (€49/month) covers:

The subscription does not cover:
The subscription is billed monthly from the date of first payment. It renews automatically unless cancelled. You may cancel at any time by emailing hello@briefly.pt. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.
Upon receipt of full payment and delivery of the final files, you own the deliverable outright. This includes all source files provided to you. You may use, modify, publish, and redistribute the website without restriction.
We retain the right to display the project in our portfolio and for promotional purposes (website, social media, case studies), unless you explicitly request otherwise in writing before the project begins.
You are responsible for ensuring you have the right to use any content you provide (text, images, logos, fonts). We will incorporate client-supplied assets in good faith but accept no liability for third-party intellectual property claims arising from content you provided.
Any stock images, icons, or fonts we source on your behalf and include in the deliverable are either royalty-free, properly licensed, or open-source. We will note any attribution requirements where applicable.
All websites are built from scratch. We do not transfer proprietary internal tools, templates, or processes. The delivered HTML/CSS/JS files are yours; any internal build tooling we use is not part of the deliverable.
Both parties agree to keep confidential any non-public information shared during the project. This includes business information, brand strategies, unreleased products, or personal data shared in the brief.
This obligation does not apply to information that is publicly known, independently developed, or required to be disclosed by law.
If you cancel after payment but before we have started work, you are entitled to a full refund, less any payment processing fees already incurred.
Once work has started (typically within a few hours of your order being confirmed), we will have already invested significant time in your project. In this case:
We reserve the right to cancel any project at any time. If we cancel before delivery, we will issue a full refund. If we cancel after delivery, no refund is due.
Approved refunds will be processed within 5 business days via the original payment method.
The service is provided "as is." We make no warranties, express or implied, regarding the service, including but not limited to fitness for a particular purpose, uninterrupted availability, or error-free operation.
To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or related to these Terms or the service shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities.
We make no guarantees regarding the business or commercial outcomes of your website, including search engine rankings, conversion rates, or revenue generated.
We collect and process personal data as described in our Privacy Policy. By using our services, you consent to that processing.
We handle all client data in compliance with the General Data Protection Regulation (GDPR) and applicable Portuguese data protection law.
These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Portugal.
If a dispute arises, we encourage you to contact us at hello@briefly.pt first. We will make every reasonable effort to resolve the issue amicably before any formal proceedings are initiated.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this document.
Continued use of our services after a change constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.
